1. Agreement to Terms

By accessing eventpixel.app or using any EventPixel service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you are not authorised to use our services. EventPixel is operated by EventPixel, New Delhi, India – 110040.

2. User Accounts

When you create an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@eventpixel.app of any unauthorised use of your account.

3. User Content & Responsibilities

Our platform allows you to upload, store, share, and make available photos, videos, voice messages, and other material ("User Content"). You, the customer, are solely responsible for all User Content that you upload or facilitate to be uploaded to EventPixel. By uploading User Content, you represent and warrant that:

  • You own all rights to the User Content, or have obtained the necessary permissions, licences, and consents from all relevant parties (including the subjects of any photos or videos) to upload and share it on our platform.
  • The User Content does not violate, misappropriate, or infringe any intellectual property rights, privacy rights, or any other rights of any third party.
  • The User Content is not illegal, defamatory, obscene, abusive, threatening, or otherwise objectionable under applicable Indian law, including but not limited to the Information Technology Act, 2000 and the Indian Penal Code.
  • You have obtained the informed consent of every individual whose image, voice, or biometric likeness appears in the User Content before submitting it through any AI Face Recognition feature.

EventPixel is not responsible for any User Content uploaded by you or your event guests. We reserve the right to remove any User Content that violates these Terms at our sole discretion, without prior notice.

4. Intellectual Property

The Service and its original content — including but not limited to the EventPixel brand, software, design, and templates — are and will remain the exclusive property of EventPixel and its licensors. You retain all ownership rights to User Content you upload.

5. Prohibited Uses

You agree not to use the Service to:

  • Upload or distribute child sexually abusive material (CSAM) or any content that exploits minors.
  • Harass, intimidate, or threaten any individual.
  • Attempt to gain unauthorised access to any system or network.
  • Use the AI Face Recognition feature on individuals without their prior informed consent.
  • Violate any applicable Indian or international law or regulation.

6. Payment & Refunds

Payments are processed securely through Razorpay. All purchases are subject to our Refund Policy. By making a payment, you acknowledge that EventPixel is a digital SaaS product and agree to our no-refund policy for created events, except as expressly stated in the Refund Policy.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms, violate our Fair Usage Policy, or engage in any conduct we deem harmful to our platform or other users. Upon termination, your right to use the Service ceases immediately.

8. Limitation of Liability

To the maximum extent permitted by applicable law, EventPixel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our aggregate liability shall not exceed the amount you paid us in the three months preceding the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

10. Changes

We reserve the right to modify these Terms at any time. Material changes will be notified via email or a prominent notice on the Service at least 15 days prior to the change taking effect. Continued use of the Service after such notice constitutes acceptance of the revised Terms.
